The second type of foreclosure, foreclosure by power of sale, involves the sale of the property by the mortgage holder not through the supervision of a court. Where it is available, foreclosure by power of sale is generally a more expedient way of foreclosing on a property than foreclosure by judicial sale. The majority of states allow this method of foreclosure. Again, proceeds from the sale go first to the mortgage holder, then to other lien holders, and finally to the mortgagor.

If the mortgagor fails, the mortgage holder automatically gains title, with no obligation to sell the property. Strict foreclosure was the original method of foreclosure, but today it is only available in a few states, such as Connecticut, New Hampshire and Vermont.

The process of foreclosure is lengthy and the timeframes for when the lending institution begins the process vary from state to state. Other factors, such as the increasing availability of personal loans for owners facing foreclosure, present homeowners with foreclosure avoidance options. In this foreclosure, the sheriff then issues a deed to the winning bidder at auction. Banks and other institutional lenders typically bid in the amount of the owed debt at the sale, and if no other buyers step forward the lender receives title to the immovable property in return.

Other states have adopted non-judicial foreclosure procedures, in which the mortgagee, or more commonly the mortgagee`s attorney or designated agent, gives the debtor a notice of default and the mortgagee`s intent to sell the immovable property in a form prescribed by state statute. This type of foreclosure is commonly referred to as "statutory" or "non-judicial" foreclosure, as opposed to "judicial". With this "power-of-sale" type of foreclosure, if the debtor fails to cure the default, or use other lawful means (such as filing for bankruptcy which provides a temporary automatic stay to the foreclosure proceeding) to stop the sale, the mortgagee or its representative will conduct a public auction in a similar manner as the sheriff`s auction described above. The highest bidder at the auction becomes the owner of the immovable property free and clear of any interest of the former owner but the property may be encumbered by any liens superior to the mortgage being foreclosed (e.g. a senior mortgage, unpaid property taxes etc). Further legal action, such as an eviction may be necessary to obtain possession of the premises.

"Strict foreclosure" is an equitable right available in some states. The strict foreclosure period arises after the foreclosure sale has taken place and is available to the foreclosure sale purchaser. The foreclosure sale purchaser must petition a court for a decree that will cut off any junior lienholder`s rights to redeem the senior debt. If the junior lienholder fails to do so within the judicially established time frame, his lien is cancelled and the purchaser`s title is cleared. This effect is the same as the strict foreclosure that occurred at common law in England`s courts of equity as a response to the development of the equity of redemption.

In most jurisdictions, it is customary for the foreclosing lender to obtain a title search of the immovable property and to notify all other persons who may have liens on the property, whether by judgment, by contract, or by statute or other law, so that they may appear and assert their interest in the foreclosure litigation. In all US jurisdictions a lender who conducts a foreclosure sale of immovable property which is the subject of a federal tax lien must give 25 days` notice of the sale to the Internal Revenue Service: failure to give notice to the IRS will result in the lien remaining attached to the immovable property after the sale. Therefore, it is imperative that the lender obtain a search of the local Federal Tax Liens so that if the persons or companies involved in the foreclosure have a federal tax lien filed against them, the proper notice to the IRS will be given.You can find:

General Information about Frankfort Kentucky

Frankfort is the capital of Kentucky. It is located in Franklin County and has an estimated population of 27,077 people. Gen. James Wilkinson purchased a 260-acre tract of land on the north side of the Kentucky River in 1786. Today this land is known as downtown Frankfort. General Wilkinson promoted to make Frankfort the State Capitol and is known as the father of Frankfort.

The name of Frankfort is thought to be named after Stephen Frank. Frank was a pioneer from Bryan`s Station who was making salt at a ford in the Kentucky River when he was killed by a group of Indians who attacked the group of pioneers. This event took place in the 1780s, after the death of Frank the crossing was called "Frank`s Ford". Later the name was shortened to Frankfort.

After Kentucky became a state, five commissioners were appointed in 1792, to choose a location for the state capital. A number of communities competed for the honor of being the capital city of Kentucky, but Frankfort won by perseverance.

General Information about Hopkinsville

Hopkinsville is a city in Christian County with an estimated population of 30,089 according to the 2000 census. Hopkinsville was settled by Bartholomew and Martha Ann Wood, in 1796. The couple was from Jonesborough, Tennessee. General Information about Louisville, Kentucky

The history of Louisville spans over hundreds of years. It has been influenced by the area`s unique geography and location. The first settlement was made in the vicinity of Louisville in 1778. Col. George Rogers Clark, who was conducting a campaign against the British in areas north of the Ohio River, came to Louisville 1778. Clark organized the Illinois Regiment, a group of 150 soldiers, eventually after heavy recruiting in Virginia and Pennsylvania. On May 12, they set out from Redstone, taking along 80 civilians who hoped to claim fertile farmland and start a new settlement in Kentucky. It was a location Clark thought ideal for a communication post, and the settlers helped Clark conceal the true reason for his presence in the area.

The regiment helped the civilians establish a settlement, clearing land and building cabins and a springhouse. Clark then took his soldiers and left to begin their military campaign. A year later Clark requested the settlers begin crossing the river, this established the first permanent settlement of Louisville. Louisville was named in honor of King Louis XVI of France. For it was his soldiers, at the time, that were aiding Americans in the Revolutionary War.

Owensboro Real Estate

General Information about Owensboro Kentucky

Owensboro, named after Colonel Abraham Owen, it is the third largest city in Kentucky. Owensboro is located in Daviess County. The city had a total population of 55,525 in 2006. Owensboro was first settled by frontiersman William "Bill" Smeathers in 1790s for which the park on the riverfront is named. The settlement was known as Yellow Banks. Yellow Banks was incorporated as a city in 1817 under the name Owensborough, named after Colonel Abraham Owen. The name was shortened in 1893 to its present spelling of Owensboro.

Frederick Ames who came to Owensboro from Washington, Pennsylvania in 1887 started the Carriage Woodstock Company. The company was designed to repair horse-drawn carriages. Ames began to manufacture a line of automobiles in 1910 under the Ames brand name. In 1912 Ames hired industrialist Vincent Benxi and the company soon became the Ames Motor Car Company. Production ceased in 1915, despite being called the "best $1500" car by a Texas car dealer. The company then began manufacturing replacement bodies for the Ford Model T. By 1922, the company then began to manufacturing furniture under the name Ames Corporation. By 1970 the Ames Company sold out to Whitehall Furniture.

Owensboro considers itself the "BBQ Capital of the world". It host its International BBQ festival and competition every second weekend in May. During the summer downtown Owensboro offers "Friday after 5"this is a 16-week series of free outdoor concerts on the downtown riverfront. The festival includes live bands, events for the whole family, and additional entertainment. The festival begins every Friday from 5:00 pm till 10:00 pm. There is an estimated 35,000 people that attends the festival.

Owensboro is also home to the Annual Owensboro Pumpkin Festival held each September. The festival consists of food vendors, crafts people, carnival rides, children and adult activities and games, and plenty of pumpkin contests. The festival hosts a weekend long concert series. The event was started by the Glen Mary Sisters in Owensboro as a way to raise awareness and funds for their mission work in the southeastern United States
